6. Academic Integrity

As a participant in our educational programs, you commit to maintaining high standards of academic integrity by:

• 6.1 Submitting only your own original work for assessments and projects
• 6.2 Properly attributing sources and avoiding plagiarism
• 6.3 Refraining from cheating, collusion, or unauthorized collaboration
• 6.4 Reporting suspected violations of academic integrity to appropriate staff

Our services are provided on an "as is" and "as available" basis. We make no warranties or representations, express or implied, regarding:

9. Educational Results Disclaimer

While we provide comprehensive training and instruction, individual learning outcomes vary based on participant effort, prior knowledge, workplace application opportunities, and other factors beyond our control. We do not guarantee specific career advancement, salary increases, certification exam passage, or employment outcomes.

10. Limitation of Liability

To the maximum extent permitted by law, OptiFlow Institute shall not be liable for:

• 10.1 Indirect, incidental, consequential, special, or punitive damages
• 10.2 Lost profits, revenue, data, or business opportunities
• 10.3 Damages arising from service interruptions, data loss, or technical failures

Our total aggregate liability for all claims shall not exceed the amount you paid for the specific program or service giving rise to the claim.

12. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Japan, without regard to its conflict of law provisions. Any legal action or proceeding arising from these terms shall be subject to the exclusive jurisdiction of the courts in Tokyo, Japan.

13. Dispute Resolution Procedures

In the event of any dispute, controversy, or claim arising from these terms or our services:

• 13.1 You agree to first attempt to resolve the matter through good-faith negotiations with our management
• 13.2 If informal resolution fails within 30 days, either party may initiate mediation proceedings
• 13.3 Mediation shall be conducted in Tokyo by a mutually agreed mediator
• 13.4 If mediation is unsuccessful, disputes may be submitted to the appropriate courts in Tokyo

14. Severability

If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable. If modification is not possible, the provision shall be severed, and the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms and Conditions, together with our Privacy Policy, Cookie Policy, and any program-specific enrollment agreements, constitute the entire agreement between you and OptiFlow Institute regarding the use of our services. These terms supersede all prior or contemporaneous communications and proposals, whether oral or written.

17. Assignment

You may not assign, transfer, or delegate your rights or obligations under these terms without our prior written consent. We reserve the right to assign these terms and transfer our rights and obligations to any successor entity in the event of a merger, acquisition, or sale of assets.

All notices to OptiFlow Institute must be submitted in writing to our registered address or via email to the contact address provided. Notices to you may be provided via email to your registered address, through announcements on our website, or by other reasonable means.
